وَاِنْ خِفْتُمْ اَلَّا تُقْسِطُوْا فِى الْيَتٰمٰى فَانْكِحُوْا مَا طَابَ لَكُمْ مِّنَ النِّسَاۤءِ مَثْنٰى وَثُلٰثَ وَرُبٰعَ ۚ فَاِنْ خِفْتُمْ اَلَّا تَعْدِلُوْا فَوَاحِدَةً اَوْ مَا مَلَكَتْ اَيْمَانُكُمْ ۗ ذٰلِكَ اَدْنٰٓى اَلَّا تَعُوْلُوْاۗ
Jika kamu khawatir tidak akan mampu berlaku adil terhadap (hak-hak) perempuan yatim (bilamana kamu menikahinya), nikahilah perempuan (lain) yang kamu senangi: dua, tiga, atau empat. Akan tetapi, jika kamu khawatir tidak akan mampu berlaku adil, (nikahilah) seorang saja atau hamba sahaya perempuan yang kamu miliki. Yang demikian itu lebih dekat untuk tidak berbuat zalim.
Pada ayat tersebut disebutkan “nikahilah perempuan lain yang kamu senangi: dua, tiga atau empat”. Sehingga masyarakat awam cenderung mengambil makna tekstual dari ayat tersebut. Sehingga melahirkan pemahaman tentang kebolehan seorang laki-laki menikahi wanita maksimal 4 orang. Karena pada ayat tersebut menerangkan bahwa laki-laki boleh memilih apakah dia ingin memiliki satu istri, dua, tiga dan paling banyak empat istri selama dia bisa berlaku adil terhadap istri-istrinya. Pemahaman ini tidak salah, akan tetapi bila dikaji secara dari dari segi kebahasaan maka akan timbul beberapa macam penafsiran tentang ayat tersebut.
Penafsiran pertama adalah penafsiran yang umum dipakai masyarakat muslim di Indonesia. dimana huruf وَpada kalimat مَثْنٰى وَثُلٰثَ وَرُبٰعَ bermakna “atau”. Meskipun secara leksikal huruf وَ memiliki makna “dan”. Namun, pada ayat tersebut sebagian mufassir mengartikan وَpada ayat tersebut dengan “atau” bukan “dan”. Penafsiran ini kemudian melahirkan dalil bahwa laki-laki diberikan kebebasan memilih apakah dia ingin beristri satu, dua, tiga dan paling banyak empat istri.
Penafsiran kedua mengatakan bahwa kata وَpada kalimat مَثْنٰى وَثُلٰثَ وَرُبٰعَ tidak bisa dimaknai dengan kata “atau”. Melainkan harus dimaknai dengan makna tekstualnya yang bermakna “dan”. Hal ini kemudian melahirkan dalil bahwa laki-laki boleh menikahi wanita paling banyak Sembilan orang. Hal ini didasarkan bahwa “dan” dimaknai sebagai penambahan pada ayat tersebut. Sehingga dua ditambah tiga ditambahempat memiliki hasil Sembilan. Pendapat ini tergolong lemah dan banyak mendapatkan pertentangan dari para ulama.
Penafsiran ketiga adalah penafsiran yang cukup ekstrem. Dimana kata مَثْنٰى وَثُلٰثَ وَرُبٰعَ dimaknai sebagai tarbi’i (kuadrat). Artinya kata مَثْنٰى pada ayat tersebut bukan berarti dua melaikan empat. Kata ثُلٰثَ bukan bermakna tiga melainkan Sembilan. Dan kata وَرُبٰعَ tidak diartikan dengan empat melainkan enam belas. Hal ini dikarenakan hasil dari dua kuadrat adalah empat, tiga kuadrat adalah Sembilan dan empat kuadrat adalah enam belas. Sehingga empat ditambah Sembilan ditambah enam belas berjumlah dua puluh Sembilan. Hal ini kemudian melahirkan pendapat bahwa laki-laki bisa menikahi wanita paling banyak dua puluh Sembilan. Pendapat ini juga dinilai lemah oleh para ulama.
Terlepas dari berbagai penafsiran diatas, penulis ingin mengkritisi tentang pegambilan Qs. An-Nisa ayat ke-3 sebagai dasar hukum bolehnya seseorang berpoligami. Karena apabila kita melihat konteks ayat, maka ayat diatas membicarakan anak perempuan perempuan yatim yang berada dalam pengasuhan atau perwalian orang lain. Dalam Islam, seorang wali boleh menikahi anak perempuan yang ada dalam perwaliannya selama wali tersebut tidak memiliki hubungan darah atau hubungan sepersusuan dengan wanita tersebut. Namun, budaya yang berkembang di Arab dan beberapa negara di timur tengah adalah seorang wanita yang dinikahi cenderung akan mengajukan mahar yang sangat besar yang apabila ditaksir nominalnya bisa mencapai ratusan hingga miliyaran rupiah. Hal ini tentu memberatkan bagi beberapa orang termasuk wali yang ingin menikahi anak perempuan yang berada dalam perwaliannya. Mengingat seorang wali tentu saja menghabiskan uang yang tidak sedikit untuk menghidupi perempuan yang ada dalam perwaliannya tersebut. Dan ketika wanita itu tumbuh dewasa dan siap untuk dinikahi justru dia masih mengajukan mahar yang besar. Maka Allah Swt, menurunkan Qs. An-Nisa ayat ke 3 sebagai solusi dari permasalahan tersebut. Dimana wali tersebut boleh menikahi wanita lain sebanyak dua, tiga atau empat, sembari mengumpulkan dana untuk menikahi perempuan yang berada dalam perwaliannya. Hal ini tentu untuk menghindarkan wali tersebut dari perzinaan karena belum bisa menikahi perempuan tersebut. Oleh karena itu, pada kalimat فَانْكِحُوْا menggunakan huruf fa’ yang bermakna “maka” yang mengindikasikan pemberian opsi kepada wali yang belum mampu menikahi perempuan dalam perwaliannya agar menikahi wanita yang lain sebanyak boleh dua, tiga atau empat.
Maka ayat diatas dipandang kurang sesuai apabila digunakan sebagai dalil khalayak umum untuk berpoligami. Karena ayat diatas khusus menerangkan kondisi seorang wali dengan anak perempuan yang berada dalam perwaliannya. sehingga kurang sesuai apabila dijadikan dalil umum bolehnya seseorang berpoligami.
Dalil yang lebih sesuai adalah sabda Nabi Saw. tentang seorang laki-laki bernama Ghailan bin Salamah ats-Tsaqafi yang masuk islam dan memiliki sepuluh istri. Maka Nabi Saw. memerintahkan kepada laki-laki tersebut agar memilih empat orang dan menceraikan sisanya. Dalam hadis lain yang diriwayatkan oleh Abu Dawud, ada seorang laki-laki al-Harits bin Qais al-Humairah al-Asadi yang memiliki delapan orang istri, lalu nabi memerintahkannya agar memilih empat diantara mereka dan menceraikan sisanya. Dalil-dalil ini dianggap lebih sesuai karena bersifat umum konteksnya, tidak seperti dalil Qs. an-Nisa’ ayat tiga yang membicarakan khusus tentang seorang wali dengan anak perempuan yang berada dalam perwaliannya.
Oleh karena itu, dalam memahami kitab suci Al-Qur’an tidak hanya bisa berpatokan pada terjemahannya saja, melainkan perlu dilakukan pengkajian terhadap aspek aspek lain sehingga seorang mufassir dapat mengeluarkan makna sebenarnya yang dimaksud pada ayat tersebut. Sehingga tidak memunculkan penafsiran yang salah dan berujung pada pengambilan istinbad hukum yang salah pula.
